Philip Morris faces a planned Dutch criminal complaint over alleged deception and prohibited advertising linked to its IQOS heated-tobacco system. The Youth Smoking Prevention Foundation announced the action on Monday, November 2, and plans to submit it to the Dutch Public Prosecution Service by mid-November, according to NL Times.
Health Claims Under Legal Pressure
The foundation alleges that Philip Morris presents IQOS as less harmful than conventional cigarettes while relying on misleading information. It also claims the company breached the Netherlands' ban on nicotine-product advertising. The allegations have not been established by a court.
NL Times reported that the National Institute for Public Health and the Environment, known as RIVM, found heated tobacco products harmful and said they do not constitute a safe alternative to smoking. That assessment adds a public-health dimension to the planned complaint and could increase reputational pressure on Philip Morris' smoke-free strategy.
Mid-November Filing Is Next
Lawyer Bénédicte Ficq helped draft the complaint, which is supported by organizations including KWF Cancer Society and the Dutch lung foundation. The campaigners are also pointing to earlier sanctions and a 2016 case that did not result in prosecution.
Philip Morris says IQOS heats tobacco rather than burning it and releases lower concentrations of toxic substances than conventional cigarettes. The company position contrasts with the foundation's allegations and the RIVM assessment reported by NL Times.
