Court Tightens Rules on Legal Aid for Measles-Vaccination Disputes

A mother who tried to challenge an official order requiring proof of measles vaccination has lost her case after filing incomplete paperwork, in a ruling that raises the procedural bar for similar disputes.
The Higher Administrative Court of North Rhine-Westphalia (OVG NRW) determined that submitting a legal-aid application without a properly filed lawsuit does not preserve the deadline for bringing a case. The decision (case number 13 E 370/26) underscores how strictly courts will enforce procedural requirements, even when social-welfare protections like legal aid are involved.
Missed Deadline by One Day
The deadline for filing the lawsuit expired on December 21, 2023. One day earlier, the mother submitted a document to the court. The judges, however, classified it solely as an application for legal aid (Prozesskostenhilfe, or PKH)—not as a formal complaint.
The OVG clarified that a legal-aid request only stops the clock on the filing deadline if it is accompanied by a valid lawsuit at the same time. Because the woman let the deadline pass without submitting a proper statement of claim, her legal challenge was deemed largely inadmissible.
No Fresh Start from Amended Order
The plaintiff argued that a revised order issued in March 2026—which included an extension for providing the vaccination proof—had triggered a new filing period.
The court rejected this reasoning. An amended order does not restart the clock for challenging the original administrative act, the judges said. The initial order remains legally binding unless the revision completely replaces the core of the original requirement.
Incomplete Forms Block Reinstatement
The woman also sought to be reinstated to her previous legal position—a process known as Wiedereinsetzung in den vorigen Stand. That attempt failed due to missing paperwork.
The legal-aid form she submitted was incomplete: sections E through J were left blank. The OVG stressed that anyone seeking reinstatement must provide all necessary documents within the application period. An incomplete declaration of personal and financial circumstances disqualifies the request, and the applicant bears responsibility for the delay.
The ruling serves as a cautionary tale: when fighting vaccination-related orders, meticulous attention to deadlines and formalities is essential. Legal-aid provisions designed to ease financial burdens do not automatically compensate for procedural missteps.
