A landmark ruling by Germany’s highest labour court has placed fresh pressure on employers to manage long-term absences, even as the government pushes through a raft of sick-leave changes that will reshape how workers prove illness and return to work. The Bundesarbeitsgericht decision on 7 May tightens the rules around the Betriebliches Eingliederungsmanagement (BEM), the country’s structured return-to-work process. Under the ruling, a dismissal on health grounds is invalid if the employer fails to offer a new BEM procedure when an employee again falls sick for more than six weeks within a single year – regardless of whether earlier invitations were rejected. A simple scan of a registered-mail receipt is no longer enough to prove the invitation was delivered.

Partial sick leave from 2027

Alongside the judicial tightening, the federal government agreed in early July to reintroduce a doctor’s certificate requirement from the first day of illness. The measure, which also abolishes the telephone-based sick note, drew mixed reactions. Companies such as Airbus and the service provider Everllence welcomed it, while medical associations and parts of industry voiced criticism. Individual employers will still be allowed to opt out of the strict requirement.

The same legislative package includes a more innovative element: starting in 2027, employees covered by statutory health insurance will be able to take partial sick leave. Workers may be classified as unfit for duty in increments of 25, 50 or 75 percent. During the first six weeks, the employer continues to pay full wages; after that, reduced sick pay kicks in. The option is available for illnesses lasting more than four weeks, and employers have seven days to object. The measure was adopted through the Beitragssatzstabilisierungsgesetz (contribution rate stabilisation law) passed on 10 July as part of the wider GKV reform.

Health investment pays off – two case studies

While lawmakers and courts tighten the rules on absence, a growing number of employers are finding that proactive health programmes reduce sick days and staff turnover. The Linz-based software firm MIC launched its “fit2mic” initiative in 2013, comprising roughly 40 separate measures from psychological counselling to fitness offers. The company now reports sick-leave days 25 percent below the industry average. Its staff turnover rate stands at 6.6 percent, well under the 15 to 20 percent common in the IT sector.

On 9 July the city of DĂĽsseldorf received a health prize for its approach. The municipal administration, which employs about 12,000 people, has introduced AI-powered ergonomics coaches, virtual-reality wellness tools and a network of 300 first responders trained in mental health support.

The market for workplace health services is responding with increasing specialisation. Such modular packages often help companies meet the requirements for certification as a “healthy employer”.

At the same time, data-driven prevention is gaining traction. Analysis of preventive check-ups and stress tests is now being used to spot early signs of potential long-term illness. According to experts, even better sleep management can yield significant productivity gains. Low-threshold interventions are also recommended: structured one-minute breaks, repeated several times a day, can heighten awareness of physical strain signals and help sustain long-term working capacity.
