Germany’s Top Court Caps Gym Contracts at Two Years as Health Sector Pivots to Personalisation

The Federal Court of Justice (BGH) ruled in July 2026 that fitness studio contracts can no longer exceed 24 months, handing gym-goers greater flexibility in a market that is rapidly shifting toward bespoke wellness offerings.
The decision lands as a growing body of research — and fresh guidance from the World Health Organization — pushes physical activity to the centre of disease prevention. A meta-analysis published in The Lancet Public Health now recommends roughly 7,000 steps per day to lower the risk of dementia, diabetes and cancer. For people aged 40 and over, experts advise two strength-training sessions per week. Studies involving more than 2,900 participants show that moderate frailty in old age triples the risk of bone fractures, a danger that targeted exercise can counteract. Yet only 23 percent of adults currently meet the recommended activity levels.
The WHO’s updated prevention guidelines, also released in July 2026, state that up to 45 percent of dementia risk can be avoided through a healthy lifestyle — regular movement, no nicotine and limited alcohol consumption being the key pillars.
Mindfulness training shows promise — but half drop out
Researchers at the University of Liechtenstein examined whether digital mindfulness programmes could boost psychological resilience among managers. In a study published in the Leadership & Organization Development Journal, Tenschert and Furtner tracked 244 executives who completed a six-week online training course. Participants reported greater resilience and self-efficacy alongside reduced stress.
There is a catch, however: the dropout rate reached 50 percent. The authors stress that digital programmes must do more to sustain long-term motivation if they are to become a reliable workplace-health tool.
Industry responds with niche models and premium pricing
The fitness sector is adapting to rising demand for tailored options. In Goiânia, entrepreneur Virginia Fonseca opened a gym that charges fees based on the female menstrual cycle. At the luxury end, São Paulo’s Vicci Studio invested roughly 8 million reais in a new facility focused on mobility and longevity; personal training there costs 7,000 reais per month.
Public education providers are also expanding their health offerings. The Volkshochschule Erkrath plans nearly 900 teaching hours in health for the second half of 2026, including a taster week in early September. In Pirmasens, courses in Hatha yoga, Yin yoga and relaxation formats for children have been ramped up since the start of the year.
The association LebensWandel e.V. is running workshops in Koblenz at the end of August 2026 aimed at helping people transition into retirement with an active lifestyle.
Early evidence on keto for mental illness
Research from the first half of 2026 looked at how ketogenic diets affect psychiatric conditions. Preliminary findings suggest symptom relief for depression, bipolar disorder and anorexia. Researchers caution, however, that medical supervision is essential before adopting such a regimen.
