A sweeping update to Germany's disability law, effective July 30, 2026, is changing how hundreds of thousands of workers with severe disabilities navigate their jobs, job applications, and tax filings. The changes stem from the GKV contribution rate stabilisation act and a revised medical assessment regulation, touching everything from dismissal protection to digital tax certificates.

Job seekers gain new legal shield

A landmark ruling from the Cologne Regional Labour Court on April 16, 2026 has clarified that candidates are not obliged to disclose their disability during interviews. Even when an employer asks an unlawful question about a disability, applicants may withhold the truth without facing accusations of fraudulent misrepresentation. Any dismissal based solely on such non-disclosure is void, the court determined, because it violates Book IX of the Social Code (SGB IX) — the termination would lack the mandatory approval of the integration office. Companies now need to revisit both their hiring practices and dismissal procedures to align with this precedent.

Partial incapacity concept introduced

The SGB IX has been expanded to include the notion of partial incapacity for work. This addition to Section 67 opens the door to more adaptable employment arrangements for those with health restrictions. Workplace prevention measures outlined in Section 167 (2) SGB IX also benefit from the updated framework.

Since the start of the year, the criteria for determining a disability grade (GdB) have shifted focus. The medical assessment principles now centre on participation in daily life rather than mere functional capacity. Officials have made clear that a GdB rating is not synonymous with an individual's ability to perform their specific job. Single scores can no longer simply be added together, and pain or psychological symptoms are now more precisely separated from physical conditions. Crucially, existing GdB ratings are protected and will not be automatically downgraded.

Tax relief goes digital

Proof of entitlement to the disability lump-sum allowance has moved online as of January 1, 2026. GdB data is now transmitted electronically to tax authorities, provided the individual files a request including their tax identification number. The annual allowances stand at €1,140 for a GdB of 50 and €2,840 for a GdB of 100. Those with the markers H, Bl, or TBl receive €7,400. Previously issued certificates remain valid, and the electronic system also captures additional markers such as G or aG.

Protection periods and a warning for claimants

When authorities lower a GdB below 50, a safeguard period kicks in: dismissal protection and extra holiday entitlement persist until the end of the third calendar month after the decision becomes final. Filing an objection or lawsuit can extend this window.

However, the Hessian State Social Court has flagged a trap for those pursuing higher ratings. Anyone who submits a new application for worsened symptoms while an existing court case over a GdB increase is still pending effectively ends the court's review period. Any subsequent deterioration must then be argued in a separate proceeding.

Looking ahead: housing benefit and EU card

The federal government's planned housing benefit reform for 2027 contains a potential stumbling block. The €1,800 allowance could be scrapped for people with a GdB between 50 and 90 unless they have care level 3. Social welfare organisations have condemned the proposal as discriminatory against older disabled citizens.

Meanwhile, a unified European Disability Card is set to launch by June 5, 2028. Pilot programmes for a digital version are already underway in Thuringia and Hamburg. The card does not trigger any reassessment of a person's GdB — it simply documents their current status.
