PepsiCo is confronting a fresh legal challenge over how it markets some of its best-known snack brands. A proposed class action accuses the US food and beverage giant of misleading shoppers by labeling certain Siete and Tostitos chips with an "Avocado Oil" claim, when the products are not prepared exclusively with avocado oil. The complaint, dated August 31, targets marketing practices in the company's high-margin snack division—an unwelcome distraction for a business that depends heavily on consumer trust in what its packaging promises.

Labeling integrity has become a broader theme for the company this month. According to Reuters, Indian authorities raided an illegal operation in Mumbai in early September, where counterfeiters had tampered with expiration dates and nutrition information on genuine export goods. Among the brands affected were products from PepsiCo as well as Nestle, Coca-Cola and Unilever. Investigators seized stockpiles of merchandise during the warehouse bust.

Planting Seeds for a More Resilient Supply Chain

Even with those pressures in play, PepsiCo continues to pour resources into its agricultural foundations. On September 10, the company convened farmers and agronomy experts from more than 35 countries at its "Global Agro University" event, an effort aimed at making potato cultivation more resilient and higher-yielding in the years ahead.

The push comes alongside a broader operational overhaul. Roughly a week ago, PepsiCo shut its bottling and warehousing site in Cheverly, Maryland. The stock has slipped 1.5% since the closure, which management attributed—according to media reports—to technological change and a marked shift in consumer habits. The move eliminated 143 jobs.

Should investors sell immediately? Or is it worth buying PepsiCo?

That tension between cost-cutting and external risk is shaping the investment narrative. PepsiCo must defend its margins in its core business while managing legal exposure and evolving shopper behavior. Earlier in the month, the company also reorganized its global media account, a decision that coincided with a 3.2% share price decline.

Governance Changes and a Mexico Innovation Forum

On the leadership front, PepsiCo is preparing for a boardroom transition. A mandatory filing with the US Securities and Exchange Commission shows the board elected Joaquin Duato as an independent director effective December 1, 2026. Duato will also join the board's audit committee on the same date.

Innovation remains a parallel priority. On Wednesday, PepsiCo hosted its second Sustainability Innovation Hub in Mexico City, inviting ten selected companies to present new technologies to its global sustainability, packaging and innovation teams. Among the presenters was Aduro Clean Technologies, which showcased its hydrochemolytic technology to the consumer giant's specialists. The focus of the forum centered on modern packaging solutions and sustainable processes.

Shares Steady Ahead of October Earnings

Despite the recent setbacks, the stock has shown signs of stabilization. Yesterday, the shares climbed 1.4% to close at EUR 114.66, leaving the price 2.8% above its 52-week low. Institutional investors have used the discounted levels for selective buying—The Manufacturers Life Insurance Company notably expanded its position on September 11, according to media reports.

The next major catalyst arrives on October 8, 2026, when PepsiCo releases its third-quarter 2026 results. The reporting period ended September 5, 2026, and an analyst Q&A session is scheduled for the same day.
