Sellers on marketplaces such as eBay and Etsy are staring down a compliance headache: from June 19, 2026, every online merchant in Germany must offer customers a one-click electronic withdrawal button. The rule, embedded in the new § 356a of the German Civil Code (BGB) and based on EU Directive 2023/2673, applies to all distance contracts with consumers. But the real sting is for third-party vendors who rely on platforms that may not be ready in time.

By late May 2026, eBay had not yet rolled out a native withdrawal-button function for its marketplace sellers. Hobby sellers and small businesses on Etsy face a similar gamble — it remains unclear whether the platform will have a compliant feature by the cutoff date. In either case, the merchant remains legally responsible. Even if a platform drags its feet, the individual seller is liable to the consumer for providing the button, meaning they must rig their own solution — for instance, by embedding external direct links in their seller profiles. While legal experts assess the risk of formal warnings on DIY-heavy platforms as lower than on high-traffic commercial marketplaces, the liability itself does not vanish.

The technical blueprint for the button is precise. A clearly visible, permanently accessible link or button must carry the label „Vertrag widerrufen“ (Rescind contract). The process itself is a two-stage affair. On the first click, the customer lands on a confirmation page where they enter their identity, the contract description, and a contact channel. Only the second click — on a button reading „Widerruf bestätigen“ (Confirm cancellation) — actually triggers the withdrawal. Following that, the business must immediately confirm receipt digitally and document the declaration along with the time and date of arrival.

Failure to implement the button — or implementing it incorrectly — carries consequences beyond simple non-compliance. Consumer-protection associations and warning-letter organisations can issue complaints and demand contractual penalties. Rival businesses, however, have seen their ability to pounce limited since 2020: amendments to competition law prevent competitors from reclaiming warning costs in cases of information and labelling violations, reducing the financial pressure from that direction. Still, a missing or non-compliant button can extend the consumer's grace period on withdrawal rights, effectively keeping the door open longer for returns.

Retailers cannot limit their preparations to the button alone. Withdrawal instructions and privacy statements must be overhauled to align with the new requirements. The mandatory function covers all B2C distance contracts where no statutory right of withdrawal is excluded — for example, custom-made items, which remain exempt.
